Tourist Lodging Contract - Olas Verdes Hotel

Article 1 – This tourist accommodation contract, as a modality of the lease contract, is regulated in all that is applicable to it by the provisions of the Civil and Civil Procedure Codes, and is personalized (personal data and dates of the contract) at the time that Olas Verdes Hotel accepts that a person registers as a guest, and is based on Decree No. 44256-MEIC-TUR, published in La Gaceta No. 227, of December 7, 2023.

Article 2 – Reservation confirmations include the categories of accommodation, rates of the services to be purchased, description of the service, form and time of payment, cancellation policies, time of entry and time of departure, and return policies, among others. Reservations, modifications, and cancellations are valid only when they are in writing.

Article 3 It is strictly forbidden to carry out illegal activities in the facilities of Olas Verdes Hotel, such as drug trafficking, human trafficking and commercial sexual exploitation of children and adolescents, as well as exhibitionism, harassing others, and aggressive or immoral behavior, among others, in order to maintain a healthy and safe environment for all.

Article 4 – By accepting the reservation, the guest automatically acquires the following obligations of this Agreement:

a) Pay the agreed price at the time required by Olas Verdes Hotel in accordance with the Lodging Contract.

(b) To restore the room to the condition in which it was received, except for loss or deterioration that is not the result of improper use, negligence, or recklessness.

(c) Use the room, fixtures, and furniture for the purpose for which they are intended. Improper use entitles Olas Verdes Hotel to unilaterally cancel the contract and request compensation for damages.

Article 5 – Improper use shall be understood as non-compliance with the following prohibitions:

a) Receiving, without authorization from the Hotel, people who are not registered as guests.

b) Keeping in the rooms or facilities flammable, explosive, corrosive, narcotic, or any other type of materials that endanger the company’s property, or the safety or life of people.

c) Promoting and participating in illegal activities, such as drug trafficking, trafficking of persons and commercial or sexual exploitation of children and adolescents in rooms or facilities.

Article 6 – Unless a different term is established, the accommodation contract is made for one day. If the room is not vacated by the guest, it is tacitly extended for one more day and so on. If the accommodation will no longer be available, Olas Verdes Hotel will make the communication, at least 24 hours in advance, by any or a combination of the following means: by the email indicated on the registration sheet, the email used during the reservation process, the Olas Verdes Hotel application, WhatsApp, and/or by note placed in your suite.

Article 7 – The company is not responsible for any loss or damage suffered by the valuables or goods of the guests, except in the following cases:

a) Jewelry or valuable items, when these have been deposited in the safe deposit box of the Hotel Management and the guest has previously declared the amount or content of the deposit to the Olas Verdes Hotel Reception.

b) Clothing and other baggage, if it is proven that the company has failed to take necessary and reasonable security measures.

Article 8 – The policies for reservations, cancellations, minors, pets, and smoking are as follows:

DEPOSITS: For GREEN SEASON reservations, payment is required 7 days prior to arrival. For HIGH SEASON and SUMMER SEASON reservations, payment is required 30 days prior to arrival. For GROUPS (4 or more suites) and PEAK SEASON, a 25% deposit is required to confirm your reservation. Payment of the balance (75%) must be made 60 days prior to arrival. Also, for groups and during peak season, a minimum stay of 4 nights is required. Miscellaneous charges must be paid at check-out with cash (U.S. dollars or colones), VISA, MasterCard or American Express.

CANCELLATIONS: For GREEN SEASON cancellations received more than 7 days prior to arrival, a full refund will be given. For HIGH SEASON and SUMMER SEASON cancellations, a full refund will be applied when received 30 days or more prior to arrival. For GROUPS (4 or more suites) and PEAK SEASON, a 75% refund will apply for cancellations made 61 days or more prior to arrival; all cancellations received 60 days or less prior to arrival are non-refundable. Reservations, confirmations, and cancellations must be made in writing. There are no refunds for no-shows, unused services, or unused portions of bookings.
Complementary services are non-refundable and non-transferable. Bookings are non-transferable. A no-show on the day indicated for your arrival is considered a late cancellation (it will void the reservation) and is non-refundable.

CHILDREN: Children 5 and under stay free when sharing a suite with two adults. Maximum 4 people per Luxury Suite, 3 people per Poolside Suite and 8 people per Beach Apartment.

PETS: Pets are not allowed in Olas Verdes. Please inquire prior to your arrival, for our Companion Dog Regulations.

ARRIVALS & DEPARTURES: Check-in time begins at 2:00 pm. Check-out time is 11:00 a.m.

SMOKING: By law, smoking is prohibited in suites and any of the hotel’s common areas, including the restaurant and trails in the National Wildlife Reserve. However, guests are allowed to smoke in a designated outdoor area. Please inquire at Reception. If a guest or visitor smokes inside a suite, it automatically allows Olas Verdes Hotel to request their removal from the hotel and the termination of this
contract, leaving any balance of lodging payment as compensation and without liability for Olas Verdes Hotel.

Article 9 – If the guest refuses to vacate the room on the established date and time, without fortuitous cause or force majeure, the company will proceed to deposit the luggage in storage or other secure place, after documenting the action, which will be signed by an authority or notary together with the Manager of Olas Verdes Hotel or his representative.

Article 10 – If, before leaving the establishment, the guest has not paid the agreed rate, plus consumption and additional expenses incurred during their stay, the company may retain their luggage in accordance with the provisions of article 1143 of the Civil Code and go to the competent authority.

Article 11 – Olas Verdes Hotel is committed to ensuring the physical and patrimonial security of its guests and workers, applying measures such as: lighting of public areas, surveillance systems and personnel trained in security.
